For the purposes of this notice, ‘KANAL’ refers to:

KANAL Architecture (Fondation CIVA), a public benefit foundation [Fondation d’utilité publique], company registration number 0653.956.380 ;

The commercial companies created by KANAL, namely:

AGENCE KANAL F&B, a limited liability company [société à responsabilité limitée] responsible for managing the five spaces created within the site for the purpose of hosting food businesses. (Brasserie, Restaurant, Bakery, Kiosk and Rooftop), company registration number 1014.559.919 ;

AGENCE KANAL EXPERIENCE, a limited liability company [société à responsabilité limitée] responsible for reception and mediation staff, for managing site admission (ticketing), and for the retail spaces ancillary to the exhibition and performing arts venues, company registration number 1016.885.246 ;

AGENCE KANAL HOSPITALITY, a limited liability company [société à responsabilité limitée] responsible for the temporary and event-based leasing of spaces including the provision of services, company registration number 1016.905.933 ;

AGENCE KANAL DEVELOPMENT, a limited liability company [société à responsabilité limitée] responsible for promoting the activities of the Fondation KANAL and its brand in collaboration with Sponsor and/or Advertiser partners, company registration number 1021.790.575.
These entities all occupy the KANAL site.
The term ‘KANAL site’ refers to the property complex of more than 40,000 m² owned by KANAL and located between Square Sainctelette, Quai des Voiries, Quai des Péniches and Quai de Willebroeck in 1000 Brussels, as well as the annex building ‘K1’ located at Avenue du Port 1 in 1000 Brussels.
KANAL undertakes, within the framework of its activities and in accordance with Belgian and European legislation (General Data Protection Regulation (GDPR)) on the protection of privacy, to ensure the protection, confidentiality and security of the personal data of users of its services and to respect their privacy.
In this notice:

The terms ‘We’ and ‘Our’ refer to KANAL, which offers an optimal visitor experience;

The term “You” refers to the person who registers himself/herself and any accompanying persons (e.g., family members) for an event or any other interaction requiring the transmission of personal data to KANAL (for example, booking a table at our restaurants). This term also refers to any person entering the public areas of the site without registering for an activity.

The terms ‘Your personal data’ refers, firstly, to personal data enabling the direct or indirect identification of a natural person, obtained from the person who registers himself/herself and/or accompanying persons (e.g. family members) for an event or through any other interaction requiring the transmission of personal data to KANAL. Secondly, it refers to personal data obtained from surveillance camera images for all persons present on the KANAL site.
Who are we?
KANAL operates a property complex covering more than 40,000 m² that houses a museum of modern and contemporary art, an architecture museum, commercial spaces and HoReCa facilities
We are responsible for providing you with an optimal visitor experience.
We process your personal data in complete confidentiality and security.
We are responsible for the processing of your personal data.
When do we collect your personal data ?
We collect your personal data that we receive:

when you fill out a registration form for an event taking place on the site;

when you visit an exhibition or participate in an event taking place on the site;

when your ticket(s) are scanned at the museum entrance;

when you respond to a satisfaction survey or for any other interaction you may have related to your visitor experience on the site;

in order to ensure the security of events and for any other measures aimed at providing you the best possible visitor experience;

when you book a table in our restaurants;

when you enter the site’s premises;

when you browse the KANAL website.
What categories of data are collected?
When you book an activity on the KANAL website
In this case, we will collect the following personal data:

Surname, first name;

Email address;

Telephone number;

Any information that will enable us to offer you the best possible visit (such as the need for a wheelchair, etc.).
This information will be collected from individuals who have requested information and/or registered to participate in an activity listed on the KANAL site, as well as any information necessary to provide an optimal visitor experience.
When you book a table directly on our website:
In this case, we will collect the following personal data:

Telephone number;

Any food allergies.
When you browse the KANAL website :
In this case, we will collect the following personal data:

The IP address of the device used;

The URL you accessed.
When you enter the KANAL site :

What is the purpose of data collection?
In the context of the performance of a contract with you

To manage the bookings and events you have registered for;

To process and track your order and booking;

To process payments;

To improve the products provided and offer personalised and specific products based on the information and data provided;

To manage event security;

To handle inquiries, requests and complaints;

To send newsletters;

To pass on this personal data to other partners in the context of the fulfilment of the contract (e.g. to pass on your data to the restaurant if you have made a table reservation, or for processing payment for the activities you have chosen).
For our legitimate interests
We may process your personal data if such processing is necessary for the purposes of a legitimate interest pursued by KANAL.
It is generally accepted that the management of its day-to-day activities, the security of its facilities and equipment, internal control, the production of statistics and market research with a view to improving services constitute legitimate interests of KANAL.
Within the framework of your consent
For example, if you wish to receive the KANAL newsletter, we will use your personal data (your email address) after receiving your consent to send it to you. This consent may be revoked at any time.
How will we share your personal data?
Your personal data may be shared within KANAL:

for purposes of welcoming you and providing services related to your request;

In addition to sharing personal data within KANAL, between the various entities mentioned in the preamble, we may share your personal data with certain categories of third parties, including:

How long will we keep your personal data?
We will keep your personal data for as long as necessary to respond to your request and to comply with our legal obligations.
Will your personal data be transferred outside the European Union?
In most cases, your personal data will be stored within the European Union.
If necessary, your personal data will only be transferred to countries that are subject to an adequacy decision by the European Union, ensuring that measures equivalent to those provided for under the General Data Protection Regulation, are implemented.
What security measures does KANAL implement to protect your personal data?
We implement appropriate legal, technical and organisational security measures, including information technology security and physical security measures, to adequately protect personal data. These measures are tailored to the risks associated with the processing of personal data and to the sensitivity of such data. Furthermore, these measures are continuously improved as security technologies and services evolve.
Third-party service providers to whom your personal data is disclosed, are required to protect its confidentiality and security. They may only use it in accordance with applicable laws and regulations.

To request access to the personal data concerning you that we process: this right allows you to determine whether we hold personal data relating to you and to obtain such information through a copy of the specific data and categories of data collected.

To request rectification of your personal data: this right allows you to have your personal data corrected if it is inaccurate or incomplete.

To object to the processing of your personal data: this right allows you to request that we cease processing your personal data.

To request the erasure or deletion of your personal data: this right allows you to request the erasure or deletion of your personal data, including when it is no longer necessary for the purposes for which it was collected.

To request the restriction of the processing of your personal data: this right allows you to ask us to process your personal data only in limited circumstances, including with your consent.

If our processing of your personal data or part thereof is based on your consent, you may withdraw your consent at any time. We will then cease any further processing of your personal data (however, such withdrawal will not affect the lawfulness of any data processing activities carried out previously).
Please note that we will not always be able to comply with a request for deletion, restriction, objection or data portability.
Our legal obligations and the exception to these rights will be assessed on a case-by-case basis.
How to exercise your rights?
You will need to send us a written request accompanied by proof of identity to the following email address: privacy@kanal.brussels or by post to KANAL, 11-12 Square Sainctelette, 1000 Brussels.
If you wish to lodge a complaint or if you feel that we have not responded to your requests satisfactorily, you can contact the Belgian Data Protection Authority.
